1. 1. This matter is taken up by this Tribunal through Hybrid mode.
2. 2. The present **Chamber Appeal No. 01/2025** has been filed by the Lead Bank, Punjab National Bank (PNB), under Section 19(25) of the Recovery of Debts and Bankruptcy Act, 1993 read with Rule 5(5) of the Debts Recovery (Procedure) Rules, 1993, challenging the order dated 19.08.2025 passed by the Ld. Registrar, DRT-III, Delhi, whereby registration of the Original Application (OA) was declined on the ground that the defects were not removed within the stipulated time.
3. 3. On perusal of the record, it is evident that the Applicant Bank had e-filed the OA on 29.04.2025, and thereafter cured all objections raised by the Registry by uploading the complete documents, clarifying limitation, and submitting an undertaking dated 28.07.2025 confirming compliance. The correspondence exchanged with the Registry indicates that the Applicant acted diligently and removed all defects within a reasonable period.
4. 4. The impugned order dated 19.08.2025 merely notes non-removal of defects without assigning any substantive reasons, contrary to the mandate of Rule 5(4) of the Debts Recovery (Procedure) Rules, 1993. The record also establishes that the OA was filed within limitation, supported by written acknowledgments of liability dated 05.02.2024 and 05.06.2023, attracting the benefit of Section 18 of the Limitation Act, 1963, as affirmed in *Dena Bank v. C. Shivakumar Reddy* (Civil Appeal No. 1650 of 2020).
5. 5. Considering the above facts and legal position, the impugned order dated 19.08.2025 is set aside. The Registry is directed to register the Original Application filed by Punjab National Bank and place it before the Tribunal for adjudication on merits in accordance with law.

1. 6. The **Chamber Appeal No. 01/2025** is accordingly allowed.
2. 9. Consign the file into the record room.
