5/08.10.2026 This petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 27.01.2026 passed by learned Civil Judge (Senior Division)-II, Jamtara in Original Suit No.18 of 2018 whereby the application dated 21.11.2025 filed by the respondent nos.13 to 17 under Order I Rule

10 (2) read with Section 151 of C.P.C. for their impleadment as defendants has been allowed in a case arising out of partition suit.

2. It transpires that in the partition suit, the widow and the daughters of defendant no.2 have filed the petition for impleadment and in that background, the learned court has been pleased to allow their impleadment in the said suit.

3. Prima-facie, the interest of the widow and the daughters are there as directly they are related to defendant no.2, and in that view of the matter, the learned court has rightly passed the said order.

4. There is no illegality in the said order, and as such, this petition being C.M.P. No. 1091 of 2026 is, hereby, dismissed.

5. However, the rejection of the instant C.M.P will not prejudice the case of either of the parties.
