Order No:-02 Dated:-07-10-2026
Heard the parties.
Apprehending his arrest in connection with Telaiya P.S. Case No.140 of 2026 instituted under Sections 103(1), 61(2), 3(5) of the B.N.S., 2023, the petitioner has moved this Court for grant of privileges of anticipatory bail.
Learned senior counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner being the Manager of Sacred Heart School, Jhumri Telaiya, was instrumental in commission of death of the son of the informant namely Udit Raj. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-16 of the instant bail application, learned senior counsel for the petitioner submits that the petitioner has no criminal antecedent. Drawing attention of this Court towards paragraph-154 of the case- diary, learned senior counsel for the petitioner submits that during the investigation of the case, police came to know that the tower location of the petitioner was found to be at Kota in the State of Rajasthan on 03.05.2026- on which date the alleged occurrence took place. It is further submitted that the wife of the petitioner also produced documents to the effect that the daughter of the petitioner namely Shreya Kumari was to appear in the NEET Examination and in that connection, the petitioner was at Kota and the connected hotel bill, railway ticket, copy of bill of the lodge were also produced and the same have also been filed along with this anticipatory bail application. It is also submitted that the petitioner has been implicated in this case only for the purpose of wreaking vengeance. It is lastly submitted that the petitioner undertakes to co- operate with the investigation of the case. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.
Learned Addl. P.P appearing for the State and the learned counsel for the informant oppose the prayer for anticipatory bail of the petitioner.
Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within two weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Koderma in connection with Telaiya P.S. Case No.140 of 2026 with the condition that he will co- operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the pendency of case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
