Order No.02 Dated-07-10-2026
Heard the parties.
Apprehending their arrest in connection with Pahar P.S. Case No.36 of 2026 instituted under Section 69 of the B.N.S., 2023, the petitioners have moved this Court for grant of privileges of anticipatory bail.
Learned counsel appearing for the petitioners submits that the allegation against the petitioners is that the petitioner No.1 has committed rape upon the informant. It is submitted that the allegation against the petitioners is false. It is further submitted that the petitioner No.1 has solemnized marriage with the informant subsequent to lodging of the F.I.R. It is next submitted that the petitioner Nos.2 and 3 are females and there is no allegation against them of being involved in any sexual harassment of the informant. It is lastly submitted that the petitioners undertake to co-operate with the investigation of the case. Hence, it is submitted that the petitioners be given the privileges of anticipatory bail.
Learned Addl. P.P appearing for the State vehemently opposes the prayer for anticipatory bail of the petitioners and submits that the genuineness of the photocopy of the marriage registration certificate is required to be verified. It is next submitted that subsequent marriage, even if assumed to be true, will not condone the offence of rape committed by the petitioner No.1. It is further submitted that the custodial interrogation of the petitioner No.1 is required during the investigation of the case; keeping in view commission by the petitioner of the serious offence of rape. Therefore, it is submitted that the petitioner No.1 ought not be given the privileges of anticipatory bail.
Considering the direct allegation of serious nature against the petitioner No.1 namely Kartik Kumar Mandal @ System, this Court is not inclined to grant the privileges of anticipatory bail to the petitioner No.1 namely Kartik Kumar Mandal @ System.
Accordingly, the prayer for anticipatory bail of the petitioner No.1 namely Kartik Kumar Mandal @ System is rejected.
Considering the fact that petitioner Nos.2 and 3 are women having no criminal antecedents and there is no serious allegation against them, I am inclined to grant privileges of anticipatory bail to the petitioner No.2 namely Urmila Devi @ Bewa and the petitioner No.3 namely Menu Devi @ Minu Devi. Accordingly, the petitioner No.2 namely Urmila Devi @ Bewa and the petitioner No.3 namely Menu Devi @ Minu Devi are directed to surrender in the Court below within two weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rajmahal in connection with Pahar P.S. Case No.36 of 2026 with the condition that they will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish their mobile number and photocopy of the Aadhar Card with an undertaking that they will not change their mobile number during the pendency of case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
