B.A. No. 8520 of 2026
------ Seeraj Ansari, aged about 61 years, S/o Late Ajmuddin Ansari, R/o village –Melani, P.O. & P.S. –Chanho, District – Ranchi.
… Petitioner
Versus The State of Jharkhand … Opposite Party
------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY
------
For the Petitioner : Mr. Altamash Khan, Advocate For the State
: Mr. Manoj Kr. Mishra, Addl. P.P. ------ Order No.03 Dated- 05.10.2026
Heard the parties.
The petitioner has moved this Court for grant of bail in connection with S.T. Case No. 60 of 2026 arising out of Bhandra P.S. Case No.72 of 2024 registered for the offences punishable under sections 303(2), 317(2), 317(4), 3(5) of the B.N.S., 2023.
This is the third journey of the petitioner with the prayer for regular bail. Earlier the prayer for regular bail of the petitioner has been rejected twice vide order dated 17.06.2025 in B.A. No. 4691 of 2025 and vide order dated 16.01.2026 in B.A. No. 43 of 2026. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has committed theft of 35 pole conductor and 29 pole ACSR Rabbit Conductor. It is further submitted that the fresh ground is that so far three witnesses have been examined in this case by the trial court but none of them have identified the petitioner in the court not stated anything to implicate the petitioner in this case. It is next submitted that the petitioner has been in custody since 09.04.2025, as has been mentioned in paragraph no. 02 of the supplementary affidavit dated 21.09.2026. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail.
The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Lohardaga, in connection with S.T. Case No. 60 of 2026 arising out of Bhandra P.S. Case No.72 of 2024 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
