( 2026:JHHC:29596 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 5537 of 2026

------ Jauni Kumar, aged about 34 years, S/o Shaligram Kapri, R/o Bgram-douki, P.O. Sabalpur, P.S. Panjwara, Banka, Bihar - 813104.

… Petitioner

Versus The State of Jharkhand … Opposite Party

------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY

------

For the Petitioner : Mr. Shivam Anand Pathak, Advocate For the State

: Mr. Subodh Kr. Dubey, Addl. P.P. ------ Order No.02 Dated- 01.10.2026

Heard the parties.

Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Barharwa P.S. Case No.118 of 2026 registered under sections 85, 352, 351(2), 351(3) of the B.N.S., 2023 and under Section 3/4 of the D.P. Act.

The Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner being the husband of the informant treated her with cruelty in connection with demand of dowry. It is then submitted that admittedly the matter has been twice settled between the informant and the petitioner. First on 15.05.2025 within the premises of Barharwa Police Station and second time on 07.07.2025 in Panjwara Police Station in the presence of Mukhiya, Sarpanch and village Panches. It is next submitted that there is further allegation that the petitioner is neglecting the informant and their son and claiming that he is having illicit relationship with a girl through whom he has become the father of a daughter and is proposing to marry that girl and is criminally intimidating the informant on her refusal to sign the divorce papers. It is further submitted that the allegations against the petitioner are all false and after compromise, there is no allegation of demand of any dowry or treatment of any cruelty meted out to the informant. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-04 of the instant anticipatory bail application It is then submitted that admittedly the petitioner is a government teacher. It is next submitted that the petitioner undertakes to cooperate with the investigation of the case. Hence, it is submitted that the petitioner be given the privilege of anticipatory bail.

Learned Addl. P.P. on the other hand vehemently opposes the prayer for grant of anticipatory bail and submits that there is requirement of custodial interrogation of the petitioner in view of the allegation against the petitioner. Hence, it is submitted that the petitioner ought not to be given the privilege of anticipatory bail.

Considering the fact that after compromise on 07.07.2025, there is no allegation of any demand of dowry or perpetration of any cruelty except of neglecting the informant and their son by not coming to the informant and proposing to marry another lady through whom the petitioner has a daughter, this Court is of the considered view that this is a fit case where the above-named petitioner be given the privilege of anticipatory bail. Hence, in the event of his arrest or surrender within a period of two weeks from the date of this order, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Rajmahal (Sahibganj), in connection with Barharwa P.S. Case No.118 of 2026 with the condition that the petitioner will cooperate with the investigation of the case and appear before the Investigating Officer as and when noticed by him and will furnish his mobile number and a copy of his Aadhar Card in the court below with the undertaking that he will not change his mobile number during the pendency of the case subject to the conditions laid down under section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
