Heard the parties.

The petitioner has been made accused in connection with Nala P.S. Case No.36 of 2026 registered for the offences punishable under Section 303(2) of the B.N.S., 2023.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in commission of theft of motorcycles and three stolen motorcycles were recovered from his possession. It is submitted that the allegation against the petitioner is false. It is next submitted that though the petitioner is not named in the F.I.R. yet he has been implicated in this case only on the basis of confessional statement of the co-accused Dhiren Kumar Mandal.
