Heard Mr. Indrajit Sinha, learned counsel appearing for the appellant and the learned Special P.P. appearing for the State.

This appeal is directed against the order dated 03.07.2026 passed by the learned Additional Sessions Judge VI, Dhanbad in B. P. No. 470 of 2026 arising out of Barwadda P. S. Case No. 79 of 2026 whereby and whereunder the prayer for bail of the appellant has been rejected.

3. The prosecution case reveals that in course of investigation in Barwadda P. S. Case No. 11 of 2026, it came to light that the appellant collects extortion money for Prince Khan. The amount collected as extortion money is sent to Prince Khan and Gopi Khan and by creating a terror in the society the gang is also involved in sale and purchase of arms and ammunitions. Due to the intense pressure created by the police, the appellant had appeared on 18.05.2026 in connection with Barwadda P. S. Case No. 11 of 2026. It has been alleged that the appellant had confessed that since the year 2022-23 he is attached with the organized crime syndicate run by Prince Khan, Gopi Khan, Bunti Khan and Godwin Khan and is involved in various nefarious activities of the gang. The appellant had also confessed that as the terror of Prince Khan and Gopi Khan in the society increased, he started earning more and had constructed a luxurious house and had also invested in land in the name of his wife, relatives and friends. Modern and sophisticated weapons were supplied from across the border by Prince Khan for creating turmoil in the country. On the confession of the appellant, one revolver, one pistol and 5 cartridges were recovered by the police.

Based on the aforesaid allegations, Barwadda P. S. Case No. 79 of 2026 was instituted.

4. It has been submitted by Mr. Indrajit Sinha, learned counsel for the appellant that on completion of investigation, charge-sheet has been submitted on 15.07.2026 against the appellant. The appellant is a land broker and the deeds and agreements which were purportedly recovered from the house of the appellant are all related to his business. The appellant also regularly files income tax returns. It has further been submitted by the learned counsel for the appellant that the present case is an off-shoot of Barwadda P. S. Case No. 11 of 2026 in which the appellant has already been granted bail in B. A. No. 8309 of 2026. He further submits that the appellant is in custody since 05.05.2026.

5. Learned Special P.P. for the State has opposed the prayer for bail of the appellant and has submitted that the appellant is an active member of the Prince Khan gang and by terrorizing the people, he has indulged in transaction relating to the land. He has also submitted that the appellant has got several criminal antecedents.

6. Mr. Sinha, learned counsel for the appellant in response to the submission regarding the antecedents of the appellant has stated that in 2 cases the appellant has been acquitted, in 2 cases he is on bail and in Barwadda P. S. Case No. 297 of 2025 he is not an accused.

8. It appears that the appellant had presented himself before the police station in connection with Barwadda P. S. Case No. 11 of 2026 and in course of questioning, he had confessed of his involvement with the gang run by Prince Khan and Gopi Khan and on the basis of which a revolver, pistol and 5 cartridges were recovered. No. 470 of 2026, direct that the appellant above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Judicial Magistrate 1st class, Dhanbad in connection with Barwadda P.
