03/30.09.2026 The present writ petition has been filed for issuance of direction upon the concerned respondents to remove the obstruction made over the rivulet known as ‘Rajdanr’ crossing through the petitioners’ village by a company, namely, Monte Carlo Private Limited (the respondent No.8), which has been assigned the work of Hurra C Mining Project under a Mine Developer and Operator (MDO) contract with the respondent-Eastern Coalfields Ltd., Rajmahal Mining Area.

2. Mr. Kanti Kr. Ojha, learned counsel for the petitioners, submits that the respondent No.8 has been continuously dumping and stacking soil on the part of the said rivulet obstructing its natural flow as a result of which, serious ecological imbalance has been caused adversely affecting the public at large in the said area. The petitioner represented different authorities in this regard in pursuance of which certain letters were exchanged among the authorities, 2026:JHHC:29379 however, nothing concrete has been done, which has compelled the petitioners to prefer the present writ petition.

3. Mr. Rajesh Lala, learned counsel for the respondent-Eastern Coalfields Ltd., on instructions, submits that the respondent No.8 has not caused any obstruction on the part of the rivulet.

4. Be that as it may.

5. Since the issue raised in the present writ petition concerns the ecology of the concerned area, the respondent No.2 is directed to get an enquiry conducted in this regard by a team of the officials including the technical personnel. After receipt of the enquiry report, if it is found that the said rivulet is being obstructed by dumping and stacking of soil at the instance of the respondent No.8, the respondent No.2 shall take appropriate steps in accordance with law for removing the same. The said exercise has to be completed within a period of three months from the date of receipt/production of a copy of this order.

6. The present writ petition is accordingly disposed of with the aforesaid observation and direction.
