1 Cr. Appeal (DB) No. 1229 of 2026 IN THE HIGH COURT OF JHARKHAND AT RANCHI

Cr. Appeal (DB) No. 1229 of 2026 Md. Salim Shekh ... ... ... ... ... Appellant

Versus The State of Jharkhand

… … ... Respondent

--------- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY

HON’BLE MR. JUSTICE RAM SHARMA

--------- For the Appellant: Mr. Gautam Kumar, Advocate For the Respondent: Spl.P.P.

--------- 02/Dated: 29.09.2026 Heard learned counsel for the appellant and learned Spl.P.P. for the State. This appeal is directed against the order dated 02.09.2026 passed by the learned Sessions Judge, Pakur in connection with Pakur in A.B.P. No. 431 of 2026 in connection with Pakur (M) P.S. Case No. 83 of 2026, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected. It has been alleged that, on information that some persons were taking drugs and creating nuisance for the women of the village, a raid was conducted by the police, at which 40-50 persons had assembled and thrown bricks and stones at the police party. Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confessional statement of the apprehended accused persons. It has further been submitted that the appellant does not have any criminal antecedent. Learned Spl.P.P. has opposed the prayer for bail of the appellant but has submitted that the appellant is named in the confession of the apprehended accused and he was also involved in throwing bricks and stones at the police party being a member of the mob. It appears that there is total dearth of evidence so far as the appellant is concerned as the only incriminating factor against the appellant is the confessional statement of the apprehended accused. It has been stated that the appellant does not have any criminal antecedent.
