This application has been preferred by the appellant for condoning a delay of 26 days in filing the appeal. Having been satisfied with the reasons assigned in this application, the delay of 26 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of. Accordingly, I.A. No. 13228 of 2026 is allowed and disposed of. Cr. Appeal (DB) No. 1250 of 2026 Heard learned counsel for the appellant and learned Spl.P.P. for the State. This appeal is directed against the order dated 20.07.2026 passed by the learned Sessions Judge, Pakur in connection with Pakur in A.B.P. No. 336 of 2026 in connection Pakur (M) P.S. Case No. 83 of 2026, whereby and whereunder, the prayer for regular bail of the appellants has been rejected. It has been alleged that, on information that some persons were taking drugs and creating nuisance for the women of the village, a raid was conducted by the police, at which 40-50 persons had assembled and thrown bricks and stones at the police party. Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confessional statement of the 2026:JHHC:29211-DB

2 Cr. Appeal (DB) No. 1250 of 2026 apprehended accused persons. It has further been submitted by the learned counsel for the appellant that he does not have any criminal antecedent. Learned Spl.P.P., has opposed the prayer for bail of the appellant and has submitted that the appellant is named on the confession of the apprehended accused and he was also involved in throwing bricks and stones at the police party being a member of the mob. It appears that there is total dearth of evidence so far as the appellant is concerned as the only incriminating factor against the appellant is the confessional statement of the apprehended accused and as has been stated by the learned counsel for the appellant he does not have any criminal antecedent. On consideration of the aforesaid facts, we, while setting aside the order dated 20.07.2026 passed in A.B.P. No. 336 of 2026 passed by the learned Sessions Judge, Pakur in connection with Pakur (M) P.S. Case No. 83 of 2026 direct the appellant, named above, to surrender before the learned trial court within a period of four weeks and on his surrender he shall be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pakur in connection with Pakur (M) P.S. Case No. 83 of 2026. This appeal is allowed.
