HON’BLE MR. JUSTICE RAM SHARMA

--------- For the Appellant: Mr. Jitendra Nath Upadhyay, Advocate For the Respondent: Spl.P.P.

--------- 02/Dated: 29.09.2026 Heard learned counsel for the appellant and learned Spl.P.P. for the State. This appeal is directed against the order dated 14.08.2026 passed by the learned Additional Sessions Judge-V, Jamshedpur in connection with M.C.A. No. 1384 of 2026 (Arising out of N.D.P.S. Case No. 04 of 2026) Sonari P.S. Case No. 108 of 2025, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been submitted by the learned counsel for the appellant that the appellant has been implicated on the confession of co-accused namely, Lakhindar Sardar and Sushil Kerai. Learned counsel submits that the Lakhindar Sarder has been granted bail in Cr. Appeal (DB) No. 593 of 2026 while Sushil Kerai has been granted bail in Cr. Appeal (DB) No. 679 of 2026. He further adds that the appellant is in custody since 29.11.2025. Learned Special P.P. for the State, who has opposed the prayer for bail of the appellant has not disputed the fact that the case of the present appellant is on better footing than that of the co-accused, who have granted bail. Regard being had to the aforesaid facts, we while setting aside the order dated order dated 14.08.2026 passed by the learned Additional Sessions Judge-V, Jamshedpur in connection with M.C.A. No. 1384 of 2026 (Arising out of N.D.P.S. Case No. 04 of 2026) Sonari P.S. Case No. 108 of 2025, direct the appellant, named above, to be released on bail on furnishing bail
