The petitioner has been made accused in connection with Rajmahal P.S. Case No.111 of 2023 registered for the offences punishable under Section 341, 323, 307, 324, 34 and 302 of the Indian Penal Code.

Drawing attention of this Court towards para- 10 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is next submitted that the wife of the deceased who is the eye-witness to the occurrence, has categorically stated that her husband sustained injuries by falling down and became senseless and she cannot say who assaulted her husband and she has been declared hostile and even though the prosecution put leading questions to her still she did not support the case of the prosecution.
