Order No. 03

Dated 29th September 2026

Heard the learned counsel appearing for the respective parties.

The petitioner is an accused in connection with S.T. Case No. 290 of 2026 arising out of Bagodar P.S. Case No. 294 of 2025.

The prayer for bail of the petitioner was earlier rejected in BA No. 2391 of 2026.

Renewing the prayer for bail of the petitioner, submission has been advanced by the learned senior counsel for the petitioner that subsequent to the rejection of the prayer for bail of the petitioner, one of the co-accused Zainul Khan @ Arman @ Jainul Khan has been granted bail by a Coordinate Bench of this Court in B.A. No. 2737 of 2026. It has been submitted that the wearing apparels of the deceased were recovered on the confession of the said Zainul Khan. Learned senior counsel submits that so far as the petitioner is concerned only a silver-coloured iron wrench was recovered.

Learned A.P.P. as well as the learned counsel appearing for the informant have opposed the prayer for bail of the petitioner and have submitted that on the confession of the petitioner, the looted truck was recovered and for which reference has been made to Para-81 and 82 of the case diary by the learned APP. However, this submission has been made opposed by the learned senior counsel for the petitioner who while referring to the seizure list has submitted that the looted truck was recovered from the premises of Saraiyahat Police Station after which it was taken by the Investigating Officer to Bagodar Police Station.

On a perusal of the Para-81 and 82 of the case diary which has been submitted at the Bar by the learned APP, there does not appear to be any circumstances which would be indicative of the fact that the looted truck was recovered at the instance of the petitioner. In fact, the truck was recovered from the premises of Saraiyahat Police Station.

On consideration of the said fact and the fact that one of the co- accused almost similarly placed to that of the petitioner having been granted bail by a Coordinate Bench of this Court as noted above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Giridih in connection with S.T. Case No. 290 of 2026 arising out of Bagodar P.S. Case No. 294 of 2025.
