1. The learned counsel appearing on behalf of the State, at the very outset, by referring to the communication received from the Superintendent, Birsa Munda Central Jail, Hotwar, Ranchi vide memo no. 8569 dated 11.9.2024, has submitted that the sole appellant of this case, namely, Birsu Kharia, had already died on 15.5.2019 at RIMS, Ranchi during treatment.
2. The aforesaid communication dated 11.9.2024 be kept on record.
3. There is no substitution petition filed by the legal heir(s) of the appellant.
4. Accordingly, the instant appeal stands abated.
5. I.A.(s), if any, also stands abated.
6. Let Lower Court Records be sent back to the learned trial court.
