03/29.09.2026 Heard Mr. Robin Kumar, learned counsel for the appellant and learned A.P.P.

This appeal is directed against the order dated 10.08.2026 passed by the learned Additional Sessions Judge-I-cum-Spl Judge, Gumla in A.B.P. No.345 of 2026 arising out of Raidih P.S. Case No.63 of 2025, whereby and whereunder the prayer for anticipatory bail of the appellant has been rejected.

It has been alleged that a new born child was sold and the appellant has been implicated for facilitating such transaction.

Submission has been advanced by the learned counsel for the appellant that the involvement of the appellant has not come in the picture save and except for mere suspicion. It has been submitted that the appellant is a fruit seller and in fact Karina Bhagat had sold the new born baby to one Shahnaz and Firoz for which they have also entered into an agreement. Learned counsel adds that the appellant does not have any criminal antecedents.

Learned A.P.P. has opposed the prayer for bail of the appellant and while referring to the case diary has submitted that Child Welfare Committee had conducted an enquiry and the role of the appellant was detected of facilitating the transaction.

It appears from a perusal of the case diary that a vague and unsubstantiated allegation has been made that the appellant was one of the persons who facilitated the transaction of selling the new born child

2026:JHHC:29216-DB of Karina Bhagat. In fact, it would seem that what had been published in the newspaper has been primarily mentioned as the cause of the involvement of the appellant in the statement of the witnesses.

On consideration of the aforesaid facts, we while setting aside the order dated 10.08.2026 passed by the learned Additional Sessions Judge-I- cum-Spl Judge, Gumla in A.B.P. No.345 of 2026 arising out of Raidih P.S. Case No.63 of 2025, direct the appellant to surrender before the learned trial court within a period of four weeks and on his surrender, the learned court below shall release him on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Gumla in connection with Raidih P.S. Case No. 63 of 2025.

This appeal stands allowed and disposed of.
