CORAM: HON’BLE MR. JUSTICE DEEPAK ROSHAN For the Petitioner(s) : Mr. J. N. Upadhyay, Advocate For the State

: Mr. Fahad Allam, APP

-------- Order No. 02 /Dated: 25th September 2026

Heard learned counsel for the parties.

2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Section 302 IPC in connection with ST Case No. 408 of 2025 arising out of Bagbera PS Case No. 73 of 2021 (MCRA No. 1241 of 2026).

3. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. It is submitted that petitioner is not named in F.I.R and he has been implicated in this case on the basis of suspicion. He further submits that out of 11 charge-sheeted witnesses none of the witnesses has been examined till date and the petitioner is languishing in judicial custody since 07.08.2025 as such he may be enlarged on bail.

4. Learned APP opposes the prayer for bail of the petitioner.

5. Having regard to the aforesaid facts and circumstances coupled with the fact there is no likelihood of early conclusion of trial and the petitioner has remained in judicial custody for more than one year, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II at 2026:JHHC:29000

Jamshedpur in connection with ST Case No. 408 of 2025 arising out of Bagbera PS Case No. 73 of 2021 (MCRA No. 1241 of 2026).

6. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioner, learned trial Court shall be at liberty to cancel the bail of the above-named petitioner.

7. Accordingly, the instant bail application stands allowed.
