Mr. Manoj Kr. Mishra, learned A.P.P. for the State, submitted that an affidavit has been filed on behalf of the State, stating therein, that Bhatu Mandal, appellant no. 1, and Sugiya Devi, appellant no. 2, have died. It has further been urged on behalf of the State that Bhatu Mandal, appellant no. 1, died on 19.03.2010, whereas Sugiya Devi, appellant no. 2, died on 02.05.2021.

This Court perused the affidavit filed on behalf of the State.

The affidavit is well supported by a report filed by the Officer In- charge, Sariya Police Station, Giridih, and the report of the concerned Mukhiya.

After perusing the aforesaid documents, it transpires that both the appellants are no more. In view of the aforesaid fact, there is no surviving appellant to pursue the present appeal. Consequently, the present appeal stands abated.
