..... … Petitioners

Versus The State of Jharkhand

..... … Opposite Party

-------- CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI

------ For the Petitioners : Mr. M.B. Lal, Advocate. For the State

: Mr. Ajay Kumar Pathak, A.P.P. ------ 05/ 21.09.2026 Heard learned counsel for the petitioners and learned A.P.P for the State.

2. The petitioners are apprehending their arrest in connection with Sadar P.S. Case No. 110 of 2026, registered for the offence under Sections 316(2), 318(4), 61(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Chatra.

3. Learned counsel appearing for the petitioners submits that the petitioner No. 1 is father, petitioner No. 2 is mother and petitioner No. 3 is the brother of Md. Wasim. He next submits that the marriage of said Md. Wasim was fixed with the daughter of the informant, however, later on, the daughter of the informant was not willing to solemnize the marriage with said Md. Wasim. He further submits that the allegations are made by the informant that he has invested huge amount for booking of the caterers, tent house and in other purposes for the said marriage. He also submits that said Md. Wasim is already in custody. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioners.

[2026:JHHC:28551]

4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of not solemnizing the marriage with said Md. Wasim. On this ground, he submits that prayer for anticipatory bail may kindly be rejected.

5. Considering that said Md. Wasim is already in custody and the petitioners are said to be the father, mother and brother of Md. Wasim and in the FIR, the only allegations are there of investing money in preparation of marriage and in the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners.

6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Sadar P.S. Case No. 110 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
