CORAM: HON'BLE MR. JUSTICE SANJAY KUMAR DWIVEDI For the Petitioner

:Mr. Satyam Kumar, Advocate For the State : Mr. Suraj Deo Munda, A.P.P.

02/ 21.09.2026: Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner is apprehending his arrest in connection with Simariya P.S. Case No. 157 of 2025, registered under sections 318(2), 319(2), 289, 336(2), 336(3), 3(5) of BNS and section 41 of Clinical Establishment Act, 2010, pending in the Court of learned Additional Chief Judicial Magistrate at Chatra.

Learned counsel for the petitioner submits that petitioner has earlier moved before this Court in A.B.A. No.2951 of 2026 which was dismissed as withdrawn by order dated 22.06.2026 with liberty to move before the learned court. He further submits that present anticipatory bail application has been filed on the fresh ground.

5. There is no doubt that second anticipatory bail application can be entertained if there is fresh ground and if there is no fresh ground and even in argument no fresh ground is argued, in that situation the second ( 2026:JHHC:28471 )

anticipatory bail application can not be entertained. In course of argument no fresh ground has been argued by the learned counsel for the petitioner. Earlier anticipatory bail application of the petitioner has been dismissed as withdrawn with liberty to move before the learned court inspite of that without doing so the petitioner has filed second anticipatory bail application before this Court. Accordingly, this anticipatory bail application is hereby rejected.
