For the Petitioners

: Mr. Arwind Kumar, Advocate

For the State

------

02/21.09.2026 Heard learned counsel for the petitioners and learned counsel for the State.

2. The petitioners are apprehending their arrest in connection with Pirtand P.S. Case No. 07 of 2024, registered for the offence under Sections 147, 148, 149, 341, 323, 332, 353 and 504 of the Indian Penal Code, pending in the court of learned Additional Chief Judicial Magistrate, Giridih.

3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the present case and have not committed any offence as alleged in the FIR. As per the allegation, the petitioners along with 24 other named co-accused persons and 50 to 100 unknown persons obstructed Dumri-Giridih Main Road [NH 114(A)] by making unlawful assembly. They also abused the police officials while demanding compensation in connection with death of a lady in road accident. It is further submitted that the petitioners have been implicated in the case merely on the suspicion and further it has not been specified in the written report as to how they were identified as part of the said unlawful assembly. The petitioners have no criminal antecedent as has been stated in para 11 of the present anticipatory bail application. They, however, undertake to co-operate in the ongoing investigation. Hench, they may be given the privilege of anticipatory bail.

4. Learned A.P.P. opposes the petitioners’ prayer for grant of anticipatory bail.

5. Having heard learned counsel for the parties and on consideration of the materials available on record, I am inclined to grant anticipatory bail to the petitioners.

6. Accordingly, the above-named petitioners are directed to surrender before the learned court within two weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Giridih, in connection with Pirtand P.S. Case No. 07 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
