1. 1. This matter is taken up by this Tribunal through Hybrid mode.

2. 2. Matter placed before special national Lok Adalat.

3. 3. **IA no. 826/2025**, has filed on behalf of the Applicant Bank seeking permission to withdraw Transfer Application No. 199/2022. The Applicant states that during the course of exhibition of documents in TA No. 104/2022 titled State Bank of India & others vs. NCML Industries Ltd. & others, it has been noticed that the same set of documents has also been filed in the present matter. It is further submitted that TA No. 104/2022 was instituted earlier, on 19.04.2017, by State Bank of India as the lead bank of the consortium, which includes Canara Bank (erstwhile Syndicate Bank) as one of the consortium lenders. The process of exhibition of documents in TA No. 104/2022 is already underway before the learned Registrar.

4. 4. The Applicant Bank submits that the present OA/TA was originally filed by Syndicate Bank on 10.06.2019 for its individual claim, prior to its merger into Canara Bank. After merger and a comparative review of the record in both matters, it has become evident that the present proceedings cannot continue independently so long as the earlier consortium-based TA No. 104/2022 remains pending. The Applicant submits that continuation of parallel proceedings may lead to multiplicity, inconsistency, and unnecessary duplication of the record.

5. 5. It is clarified that the Applicant seeks liberty to pursue its rights, claims, and recovery in TA No. 104/2022 along with other consortium lenders. It is expressly stated that withdrawal of the present matter shall not Sd/- amount to abandonment, waiver, or relinquishment of the debt due from the defendants. The Applicant therefore prays for permission to withdraw the present Transfer Application, with the effect of such withdrawal being strictly confined to this proceeding alone.

1. 6. After considering the submissions in the application and the supporting affidavit, and upon perusal of the record, this Tribunal finds that the request is bona fide and made in order to streamline proceedings, prevent duplication, and avoid multiplicity of actions arising out of the same loan account. No prejudice is caused to any defendant by allowing subsequent TA no. /199/2022 dispose of as withdrawal, as the substantive rights of the parties survive and may be duly adjudicated in TA No. 104/2022.

2. 7. Accordingly, the application **IA no. 826/2025 is hereby allowed.** Transfer Application No. 199/2022 is disposed of as withdrawal. It is clarified that the withdrawal shall remain confined to this matter only and shall not affect, restrict, or otherwise limit the Applicant's rights, remedies, or claims in TA No. 104/2022 or in any other proceedings permissible under law.

3. 8. The file be consigned to the record room.
