5. This Cr.M.P. No. 213 of 2026 has been filed on behalf of the petitioner, namely Vivan Industries Private Limited through its Director (i.e. O.P. No.2 in Criminal Revision No. 136 of 2025, for modification of the order dated 07.07.2025 passed in Criminal Revision No.136 of 2025 to the extent that the O.P. No.2 herein, namely Prakash Kumar Singh

(i.e. Petitioner in Criminal Revision No. 136 of 2025) may be directed to revalidate the Demand Draft received by the petitioner herein (i.e. O.P. No.2 in Criminal Revision No. 136 of 2025) from the Registry of this Court.

6. Learned counsel for the petitioner has submitted that in the light of order dated 07.07.2025, passed by this Court, the petitioner herein (i.e. O.P. No.2 in Cr. Revision No.136 of 2025) was directed to obtain the said Demand Draft of Rs.8,40,000/- (Rupees Eight lakh Forty thousand only) from the office of the Registrar General of this Court by making proper application.

7. It is submitted that the petitioner has received the Demand Draft on 06.08.2025 and deposited the it on the same day, however, the same was returned by the Bank, i.e. the Canara Bank, Ranchi Main Branch, Ranchi on the ground of “Instrument out of date” (Photocopy of the Return Memo dated 07.08.2025) is enclosed as Annexure-3).

12. It appears that this Court, vide order dated 07.07.2025, passed in Criminal Revision No. 136 of 2025, has allowed the Criminal Revision No.136 of 2025 in terms of compromise between the petitioner and the O.P. No.2 and has further directed O.P. No.2 (i.e. petitioner in Criminal Revision No.136 of 2025) to pay Rs.8,40,000/- (Rupees Eight lakh Forty thousand only) by way of Demand Draft to be deposited in the Office of the learned Registrar General.

13. It appears that the Demand Draft was prepared on 07.05.2025 and as such when the petitioner (O.P. No. 2 in Criminal Revision No. 136 of 2026) received the same on 06.08.2025, its validity period has already expired.

14. It appears that now the O.P. No.2 (i.e. petitioner in Criminal Revision No. 136 of 2025) has revalidated the Demand Draft on 15.06.2026 and has produced photocopy of the same before this Court.

Let the photocopy of the Demand Draft be kept on record.
