Mr. Santanu Kumar Mitra, learned State Counsel submits that the acquisition was initiated following the due process of law in the year 1956. The land was then acquired on November 16, 1956. Necessary notification was published in the Calcutta Gazette on December 6, 1956. Award was declared in favour of the original land loser, who is the predecessor-in-interest of the petitioner on February 12, 1956. Being a post acquisition purchaser, the petitioner has no right, title and interest on the land.

Learned counsel for the petitioner has denied and disputed the submissions made on behalf of the State.
