(PER: HON'BLE MR. JUSTICE JAYANT BANERJI)

The sole submission of learned counsel for the complainant is that despite the order dated 30.10.2024, the accused had sent an email on 01.02.2025 to convene a meeting with the following agenda:

Appointment of Resolution Professional

HC-KAR

To abide by the order of the Hon'ble Apex Court for transfer of settlement of funds to CoC.

2. Learned counsel has not been able to point out any statement made in the petition that the meeting was actually held and if so, on what date. Moreover, we find from perusal of the order dated 30.10.2024 that while extending the interim order passed by this Court on 25.10.2024, this Court had observed that this order shall not preclude the respondent No.1 from seeking permission from the NCLT to convene a CoC meeting solely for the purpose of authorizing payments etc. including complying with any directions issued by the Supreme Court.

3. It has not been shown by learned counsel for the petitioner that no permission of the NCLT was sought by the accused.

4. At this stage, Ms. Sadhakshana Mudrika, learned counsel for the petitioner, states that she may be permitted to withdraw this petition.

HC-KAR

6. This petition is therefore dismissed as withdrawn with no liberty.
