ORAL ORDER

The present petition has been filed calling in question the impugned order at Annexure-'A' dated 01.09.2026. It is to be noticed that the order of transfer was called in question by the petitioner in W.P.No.23267/2026, wherein this Court after a detailed consideration while refusing to interfere with the order of transfer had reserved liberty to the petitioner to submit a representation to the respondent

HC-KAR

pointing out his difficulties which could be considered by the respondent Corporation.

2. The respondent Corporation having considered such request has passed an order at Annexure-'A' dated 01.09.2026, wherein, the request of the petitioner has been rejected.

3. The statement of objections are filed by the respondent Corporation and it is submitted that transfer has been effected due to administrative reasons.

4. Suffice it to say that the order of transfer having been upheld, the opportunity given to make a representation was considered by the respondent Corporation and rejected. In such matters, the Court cannot interfere. No doubt, the petitioner has another seven months of service left, but, in light of administrative reasons sought to be assigned and enumerated in the statement of objections and once decision is taken, this

HC-KAR

Court does not intend to enter into adjudication of such reasons.

5. However, it is observed that, if there are changes and if the respondent Corporation at any point before the petitioner attains superannuation is in a position to reshuffle, liberty is reserved to the respondent Corporation to consider the request of the petitioner. Such observation is made solely on the ground that the petitioner is on the verge of retirement.

Accordingly, the petition is disposed of. Sd/- (S SUNIL DUTT YADAV) JUDGE VGR
