PENDING ON THE FILE OF THE XLI A.C.M.M BENGALURU.

THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

CORAM: HON'BLE MR. JUSTICE RAJESH RAI K

ORAL ORDER

Learned counsel for the petitioner and learned counsel for respondent No.2 filed a joint affidavit of the parties. It is stated in the affidavit that the petitioner and respondent No.2 have amicably settled their dispute out of the Court. As such, learned counsel for the parties jointly submits that the proceedings initiated against the petitioner based on the complaint lodged by respondent No.2 be quashed.

2. Placing reliance on their submission and the joint affidavit of the parties, I am of the view that the continuation of the proceedings against the petitioner is nothing but abuse of the process of Court. Admittedly, the offences alleged against the petitioner are non-compoundable in nature. However, having regard to the fact that the dispute between the parties is purely private in nature, and in view of the principles laid

down by the Hon'ble Apex Court in GIAN SINGH V. STATE OF PUNJAB AND ANOTHER, reported in (2012) 10 SCC 303, I am of the considered opinion that the settlement arrived at between the parties can be taken into consideration.

3. Accordingly, the petitioner and respondent No.2 are permitted to compound the offences.

4. Consequently, the petition is disposed of in terms of joint affidavit of the parties. The proceedings against the petitioner/accused in Crime No.189/2024 registered by Sampigehalli Police Station for the offences punishable under Sections 341, 504 and 506 of IPC, presently, pending on the file of XLI ACMM, Bengaluru is hereby quashed.
