ORAL ORDER

1. Learned Additional Government Advocate accepts notice for respondents.

2. Heard Sri. Rajarama S., learned counsel appearing for the petitioner, and Sri. Shamanth Naik,

HC-KAR

learned Additional Government Advocate appearing for the respondent-State.

3. In this writ petition, the petitioner is assailing the Endorsement dated 07.08.2025 at Annexure-A issued by respondent No.4-Tahsildar.

4. Having heard the learned counsel appearing for the parties and on careful consideration of the impugned Endorsement at Annexure-A, it is observed that respondent No.4 has stated that the land in question belonged to the Forest Department. However, no material has been placed on record by way of any notification that has been issued by the competent authority declaring the land in question as deemed forest land.

5. In that view of the matter, the impugned Endorsement dated 07.08.2025 at Annexure-A issued

HC-KAR

by respondent No.4 cannot be sustained in law and is liable to be set aside.

6. Accordingly, the writ petition is allowed. The impugned Endorsement dated 07.08.2025 at Annexure-A issued by respondent No.4-Tahsildar is hereby set aside.

7. The matter is remitted to respondent No.4 to reconsider the same and take an appropriate decision in accordance with law, after considering the relevant material, including any material relied upon to establish that the land in question is forest land.

8. In the meanwhile, the respondent-authorities shall not take any coercive steps against the petitioner in respect of the land in question.
