2. The petitioners seek to impugn the notification dated 19.09.2026 which was published on 29.09.2026 (Annexure - A to the writ petition) whereunder a tender notification has been issued calling for bidders for the purpose of carrying of the work of solid waste management, primary collection and secondary transport of municipal solid waste and street sweeping in various divisions.

3. The petitioners are the successful tenderers pursuant to the tender notification dated 30.07.2025, consequent to which, the respondent Nos.2 to 5 - Greater Bengaluru Authority1 has issued a letter of acceptance dated 04.09.2026 inter alia 1 hereinafter referred to as 'GBA' Digitally Signed by CHEPPUDIRA MONNAPPA POONACHA

HC-KAR

calling upon the petitioners-successful tenderers to take further steps and execute the relevant agreement/s.

4. The relevant portion of the said Letter of Acceptance i.e., issued in favour of the writ petitioner in W.P. No.31195/2026 is as under: "This is to notify you that, pursuant to the government Order referred to at Reference (3) above, your tender for the work of "Primary Collection and Secondary Transportation of Municipal solid waste (MSW) and Street sweeping waste in Gandhinagar division (Package-P7) Call-02", at an annual contract price of Rs.18,14,72,472/- (Rupees Eighteen crores fourteen lakhs seventy two thousand four hundred and seventy two only) (Excluding GST), for a period of seven (7) years, as corrected and modified in accordance with the Instructions to Tenderers, is hereby accepted by the Competent Authority, subject to extension of the tender bid validity. You are hereby requested to submit the Security Deposit in accordance with Clause 3.9.1 of the RFP Terms and Conditions, amounting to Rs.90,73,623/- (Rupees Ninety lakhs seventy three thousand six hundred and twenty three only), being equivalent to 5% of one year's Contract Value. The Security Deposit shall be renewed annually. The renewal amount shall be equivalent to the anticipated annual Contract Value for the succeeding year and shall be maintained throughout the entire contract period. The Bank Guarantee furnished towards the Security Deposit shall remain valid for a period of three (3) months beyond the respective annual renewal period, i.e., for one (1) year and 135 days in respect of the first year and similarly for each subsequent year. Digitally Signed by CHEPPUDIRA MONNAPPA POONACHA

HC-KAR

The Selected Bidder shall also submit the Agreement Paper bearing stamp duty of Rs.91,500/-, (Rupees Ninty one thousand and five hundred Only) along with the Bank Guarantee (BG)/Fixed Deposit Receipt (FDR), as applicable. The Agreement shall be executed within 21 (Twenty-One) working days from the date of issuance of this LOA. Upon execution of the Agreement, the Selected Bidder shall complete the required mobilization and deployment of vehicles within 45 (Forty-Five) days from the date of execution of the Agreement. Further, Vide reference no.03 the Authority has issued a letter to extend the bid validity but however no communication received from your end. Therefore once again as per RFP Clause 3.7.7, the Authority is issuing this LOA in duplicate to the successful bidder. The successful bidder shall sign and return the duplicate copy of the LOA within seven (7) working days from the date of receipt of the LOA as acknowledgement thereof. You are therefore requested to take necessary action within the stipulated timelines. In the event of failure to submit the duly signed duplicate copy of the LOA within the stipulated period of seven (7) working days i.e. on or before 16.09.2026, further action will be taken by the Authority in accordance with the Tender Terms and Conditions."

5. It is pertinent to note here that in response to the said letter of acceptance dated 04.09.2026, the petitioners have issued a reply setting out various conditions qualifying their response. Since the successful tenderers did not come forward to take further steps to do the needful, pursuant to the letter of acceptance, consequent to the tenders awarded in their favour, Digitally Signed by CHEPPUDIRA MONNAPPA POONACHA

HC-KAR

the impugned tender notification dated 19.09.2026 has been issued. Being aggrieved, the present writ petitions are filed.

6. It is the vehement contention of learned counsel for the petitioners that consequent to the petitioners being declared as the successful tenderers, a Government

Order

dated 04.06.2026 (Annexure - E to the writ petition) has been issued whereunder a sub-committee has been formed to review the various tenders awarded. Hence, it is contended that the petitioners have set out their apprehensions in reply to the letter of acceptance.

7. It is clear from the aforementioned fact situation that the petitioners have not acted further pursuant to the letter of acceptance issued in their favour, consequent to the tender notification dated 30.07.2025. In the absence of an unqualified response from the petitioners taking further steps in terms of the letter of acceptance dated 04.09.2026, the petitioners are not entitled to call in question the subsequent tender notifications dated 19.09.2026. Digitally Signed by CHEPPUDIRA MONNAPPA POONACHA

HC-KAR

8. Accordingly, writ petitions are dismissed as being devoid of merit.

9. At this stage the learned Advocate General on instruction submits that the respondents have no objections for the participation of the petitioners in the impugned tender notification. It shall be open to the petitioners to participate in the tender proceedings consequent to the impugned tender notification 19.09.2026.
