ORAL ORDER

The present petition is filed seeking a direction to the Trial Court for expeditious disposal of O.S.No.1337/2014, pending on the file of the Senior Civil Judge and JMFC, Anekal. The said suit has been instituted seeking declaratory and injunctive reliefs.

2. Learned counsel for the petitioner submits that, even after a lapse of 12 years, the suit is still at the stage of service of notice on the defendants.

3. Considering the submission of learned counsel for the petitioner, and on perusal of the order sheet, it is noticed that, even after a lapse of 12 years, the suit remains at the stage of

HC-KAR

service of summons. It appears that service on some of the defendants is pending for want of furnishing their correct addresses or the requisite process for issuance of summons.

4. This Court finds no justification for such delayed progress in the suit. The fact that the suit continues to remain at the stage of service of summons even after 12 years indicates that the plaintiff has not been diligent in pursuing the proceedings.

5. The Trial Court is directed to proceed with the matter expeditiously and endeavour to dispose of the suit within a period of two years from the next date of hearing.

With the above observations, the writ petition stands disposed of.
