ORAL ORDER

Petitioners are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail in Crime No.156 of 2026 of Kovur Police Station, SPSR Nellore District, Andhra Pradesh State for offences punishable under Section 85 of BNS, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

2. Heard Sri.Somashekaraiah.R.P., learned counsel appearing for the petitioners and Sri.Channappa Erappa, learned HCGP appearing for respondents.

HC-KAR

3. Learned counsel for the petitioner submits that FIR in the present case has been registered based on the complaint received from Smt.Manjula who is a total stranger to the petitioners herein. Petitioners who have a good case on merits intend to approach the jurisdictional Court at Andhra Pradesh seeking anticipatory bail. Since they are apprehending arrest at the hands of the Respondent-Police or any other Police on their way to Andhra Pradesh, this petition is filed seeking transit anticipatory bail for a limited period so as to enable the petitioners to approach the jurisdictional Court at Andhra Pradesh.

4. Learned HCGP fairly does not oppose the bail petition, considering the nature of the allegations found against the accused persons.

5. The law regarding grant of transit anticipatory bail has been laid down by the Hon'ble Supreme Court in the case of Priya Indoria Vs. State of Karnataka and

HC-KAR

others reported in (2024)4 SCC 749. Considering the submissions made on behalf of the petitioners and also the nature of allegations found against them, I am of the opinion that if some protection is given to the petitioners for a limited period so as to enable them to approach the jurisdictional Court at Andhra Pradesh seeking anticipatory bail, the same would meet the ends of justice. Accordingly, the following:

ORDER

1. Criminal Petition is allowed.

2. Petitioners are granted transit anticipatory bail for a period of four weeks from the date of receipt of copy of this order.

3. The Respondent-Police or any other Police are directed to release the petitioners, in the event of their arrest in Crime No.156 of 2026 registered by Kovur Police Station, SPSR Nellore District, Andhra Pradesh State, for offences punishable under Section 85 of BNS,

HC-KAR

2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, subject to the following conditions: a) The petitioners shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only), each with one surety for the like-sum, to the satisfaction of the Investigating Officer. b) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses.
