ORAL ORDER

Accused Nos.2 & 3 in Crime No.93/2026 registered by Andersonpet Police Station, K.G.F for the offences punishable under Section 4(1), 21(1), 4 of Mines and Minerals Regulation of Development Act, 1957 and Section 303(2) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail.

2. Heard the learned counsel for the parties.

3. FIR in Crime No.93/2026 was registered by Andersonpet Police Station, K.G.F for the aforesaid offences against Disilva and the petitioners herein, based on the first information dated 13.08.2026 received from Honne Gowda M.P., Police Officer attached to Andersonpet Police Station, K.G.F. Apprehending arrest in the case, the petitioners had filed Crl.Misc.No.823/2026 before the jurisdictional Sessions Court,

HC-KAR

which was rejected on 31.08.2026. Therefore, they are before this Court.

4. A reading of the first information would reveal that, on 13.08.2026 at about 07:00 p.m., based on credible information, the first informant raided the spot where the accused persons had extracted gold mixed soil behind Mysore Mines Mill and had stocked the same in eight gunny bags. According to the prosecution, after seeing the Police, the accused persons managed to escape. Thereafter, the eight gunny bags in which the gold mixed soil was stocked by the accused persons were seized under a Panchanama and FIR was registered against the petitioner and others. The maximum punishment for the alleged offences is imprisonment for a period of 3 years. The petitioner has undertaken to co-operate with the Police for the purpose of investigation. The gunny bags in which the gold mixed soil was stocked have already been recovered in the present case. Accused no.1 has been granted anticipatory bail by this Court in Crl.P.No.14275/2026 disposed of on 28.09.2026.

HC-KAR

5. Under these circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following :

O R D E R

i) The criminal petition is allowed. ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.93/2026 registered by Andersonpet Police Station, K.G.F for the offences punishable under Section 4(1), 21(1), 4 of Mines and Minerals Regulation of Development Act, 1957 and Section 303(2) of BNS, 2023, subject to the following conditions:
