ORAL ORDER

1. The petitioners, who are apprehending arrest in Crime No.46 of 2026 registered by Antarasanthe Police Station, Mysore District, for offences punishable under Sections 105 R/w Section 3(5) of BNS, 2023 are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail.

2. Heard the learned counsel for the parties.

3. FIR in Crime No.46 of 2026 was registered by Antharasanthe Police Station, Mysore District, for the aforesaid offences against petitioner nos.1 and 2, based on the first information dated 14.06.2026 received from Smt Rathnibayi,

HC-KAR

wife of deceased Chandra. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.996 of 2026 before the jurisdictional Sessions Court, which was rejected on 07.07.2026. Therefore, they are before this Court.

4. A reading of the first information submitted by the wife of deceased on 14.06.2026 would reveal that on the said date at about 06:30 a.m. she had received a phone call from her sister-in-law, who had allegedly informed her that her husband had died. Immediately thereafter, the first informant had gone to her sister-in-law's place and found the dead body of her husband Chandra. On enquiry, she came to know that on 13.06.2026 at about 04:00 a.m. Chandra had complained about stomach pain and therefore, he was taken to a hospital at H.D.Kote. Accused persons, who came there allegedly assaulted him with their hands for the reason that he had not come to work after having received money from them. In the first information, it is further alleged that the accused persons thereafter followed Chandra and once again assaulted him with hands on his head, shoulder and legs. On the next day, Chandra had complained of stomach pain and therefore, he was

once again taken to a hospital. However, in the hospital the doctor had declared him as brought dead.

5. The post mortem report of deceased Chandra would go to show that, death is as a result of rupture on gallbladder. However, there is no allegation in first information against the accused about they assaulting Chandra on his stomach. The post mortem report of deceased Chandra would also go to show that, Chandra had suffered simple injuries on his knee and shoulder. Allegation against the petitioners is that they had assaulted him with their hands.

6. Considering the nature of allegations found against the petitioners and also the cause of death of the deceased as found in his post mortem report, I am of opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively subject to the appropriate conditions. Accordingly, the following:

ORDER

(i) The Criminal Petition is allowed.

HC-KAR
