ORAL ORDER

Accused Nos.1 to 4 in Crime No.254/2026 registered by Bidadi Police Station, Bengaluru South District, for the offences punishable under Sections 351(2), 336(3), 336(2), 340(1), 352, 316(2), 318(4) read with Section

HC-KAR

3(5) of BNS, 2023, are before this Court in this petition filed under Section of BNSS, 2023, seeking anticipatory bail.

2. Heard the learned counsel for the parties.

3. FIR in Crime No.254/2026 was registered by Bidadi Police Station, Bengaluru South District, for the aforesaid offences against the petitioners herein and others, based on the first information dated 24.07.2026 received from Sri. Shankar S/o. Late Chinnappa, who is the alleged victim in the present case. Apprehending arrest in the case, the petitioners had filed Crl.Misc.No.595/2026 before the jurisdictional Sessions Court, which was rejected on 02.09.2026. Therefore, they are before this Court.

4. A reading of the first information would reveal that one Ramegowda has filed a civil suit before the Jurisdictional Civil Court in O.S.No.159/2025 against the first informant Shankar. It appears that the advocate

HC-KAR

appearing on behalf of Shankar in the civil suit had advised him to procure certain documents and therefore, Shankar appears to have approached accused No.6- Narasimhamurthy and paid an amount of Rs.13,00,000/- to him, who had assured to provide the requisite documents to Shankar. Subsequently, accused No.6 allegedly attempted to provide fraudulent documents and therefore, the first informant requested him to repay the amount paid by him. It is further alleged that accused No.6 had conspired with the other accused persons and they all together had planned to file an appeal as against the order of injunction operating in the said suit.

5. On 23.07.2026, when the first informant approached the accused persons and requested them not to proceed with filing any appeal, the accused persons allegedly criminally intimidated him and thereafter they assaulted him with hands. Accused No.6, who was arrested in the present case, has been granted regular bail by this Court in Crl.P.No.14249/2026. So far as the other

HC-KAR

accused persons are concerned, the allegations against them are that of abusing and assaulting the victim with hands. Undisputedly, he has not suffered any injury in the said incident. The petitioners, who do not have any criminal antecedents, have undertaken to co-operate with the police for the purpose of investigation.

6. Under these circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following :

O R D E R

i) The criminal petition is allowed. ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.254/2026 registered by Bidadi Police Station, Bengaluru South District for the offences punishable under

HC-KAR

Sections 351(2), 336(3), 336(2), 340(1), 352, 316(2), 318(4) read with Section 3(5) of BNS, 2023, subject to the following conditions:

a) The petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer.

b) The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

c) The petitioners shall not tamper with the prosecution witness and they shall co- operate with the police for investigation and appear before them whenever called upon.

HC-KAR

d) The petitioners shall not involve in similar offences in future.
