ORAL JUDGMENT

(PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN)

This Writ Petition (Habeas Corpus) is filed seeking a direction to the respondents to take immediate and effective steps to trace the missing minor child of the writ petitioner and produce her before this Court.

2. We have heard Shri. Monishkumar G.H, learned counsel appearing for the writ petitioner, as well as Shri. B.N. Jagadeesh, learned State Public Prosecutor-I along with Ms. Deepthi Alva, learned High Court Government Pleader appearing for the respondents.

3. The detenue, who had been missing since 10.09.2026, has been traced in Rajasthan and has been produced before us by Shri. Manjappa T - PSI and Smt. Arshiya

- WPC 579, of the Women Police Station, Davanagere.

4. We have interacted with the detenue. She states that she had met a person through Snapchat and had gone with him to his house in Rajasthan. However, she informs us that she was taken directly to his house, where his mother and

HC-KAR

grandmother were present, and that he had not misbehaved with her in any manner. She further states that she does not wish to return to Rajasthan and is willing to go back home with her brother, who was present before us in chambers today.

5. We have also interacted with her brother.

6. In the facts and circumstances of the instant case, and having regard to the statement made by the detenue, we are of the opinion that she has been permitted to return to her home along with her brother.

7. In view of the above, this Writ Petition (Habeas Corpus) shall stand disposed of.
