ORAL ORDER

(PER: HON'BLE MR. JUSTICE JAYANT BANERJI)

The instant petition alleges willful disobedience of the order dated 10.01.2025 passed in M.F.A.No.7780/2024 whereby this Court in the appeal under Order XLIII Rule 1(r) read with Section 151 of CPC, set aside the impugned order passed by the trial Court partly and restrained defendant No.1, who is the accused in this petition from interfering with the peaceful possession of the plaintiff and creating any third party rights in respect of 'A' schedule property.

2. The submission of learned Counsel for the accused is that deeds of sale were executed by the accused on 24.05.2024 and 27.05.2024 in favour of third parties at the point of time when there was no existing interim order by the trial Court operating in favour of the complainant. It is further stated that the complainant has already filed Misc.No.25072/2024 before the trial Court seeking detention of the accused in civil prison for alleged disobedience relying upon

HC-KAR

the events of 24.05.2024 and 27.05.2024, which are the sale deeds executed by the accused.

3. In our considered opinion, it is for the complainant to approach the Civil Court and pursue his remedies in accordance with law. This contempt petition is accordingly consigned.
