ORAL ORDER

Accused No.3 in Crime No.243/2026 registered by Byatarayanapura Police Station, Bengaluru City for the offences punishable under Sections 115(2), 109(1), 351(2), 352 read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail.

2. Heard the learned counsel for the parties.

3. FIR in Crime No.243/2026 was registered by Byatarayanapura Police Station, Bengaluru City for the aforesaid offences against Yash and others, based on the first information dated 20.07.2026 received from Sri Yathish A., who is a friend of the injured victim Dixit Singh.

HC-KAR

During the course of investigation of the said case, the petitioner was arrested on 20.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.7754/2026 was rejected on 14.08.2026. Therefore, he is before this Court.

4. A reading of the first information in the present case would reveal that the petitioner is the father of accused No.1 and accused No.2 is the friend of accused No.1. On 19.07.2026, the first informant and his friends went out to have drinks at about 09:30 p.m. It appears that the petitioner and his friends were also having drinks at the place where the first informant and his friends were having drinks. Since the first informant took the water bottle of the petitioner without asking him, there was a quarrel between the first informant and the petitioner. Subsequently, the petitioner allegedly summoned his son, who came to the spot of crime along with his friend and thereafter assaulted the first informant and his friend, Dixit Singh.

HC-KAR

5. Learned High Court Government Pleader has submitted that the injured victim has suffered simple injuries in the incident in question.

6. The allegation of assaulting the victim and his friend Dixit Singh is found in the first information against accused No.1. The petitioner, who is the father of accused No.1, is in custody for the last more than two months.

7. Considering the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:

O R D E R

i) The Criminal Petition is allowed.

ii) The petitioner is directed to be enlarged on bail in Crime No.243/2026 registered by Byatarayanapura Police Station, Bengaluru City for the offences punishable

HC-KAR

under Sections 115(2), 109(1), 351(2), 352 read with Section 3(5) of BNS, 2023, subject to the following conditions:
