ORAL ORDER

During the course of arguments, on instructions by the investigation officer, learned HCGP submitted that the petitioner is not arrayed as accused in this case and he is cited as charge sheet witness No.4. Since the name of accused No.9 and CW.4 is one and same i.e., Jayanth S. Vasisht, inadvertently, the Police have filed an objection before the passport authority stating that this petitioner is accused No.9. He further submitted that accused No.9 is absconding and NBW is pending against him. In such circumstances, since the

HC-KAR

petitioner is cited only as a charge sheet witness No.4, the petition does not survive for further consideration and is accordingly, disposed of.

2. The respondent No.1 is directed to clarify the said aspect before the passport authority, forthwith.
