ORAL ORDER

The petitioner is before this Court calling in question the sale notice dated 09.02.2024 and the public auction held on 26.02.2024. This Court, while entertaining the writ petition, passed an interim order staying the conducting of the auction, subject to the petitioner paying 20% of the outstanding amount within two weeks. The condition reflected in the interim order was not complied with. Taking note of the disobedience of the interim order dated 26.02.2024, this Court, by a subsequent order dated 12.03.2024, has vacated the interim order.

2. The learned counsel for the respondents submits that during the pendency of this writ petition, the respondents have once again brought the property in question for sale through a sale notice dated 25.05.2026 and an auction was conducted on 17.06.2026 and the sale has been confirmed in favour of the successful bidder. It is also his submission that, challenging the subsequent

sale proceedings, the petitioner has already approached the DRT by filing SA.No.2499/2026.

3. Therefore, he submits that the present petition has become infructuous. But the learned counsel for the petitioner does not dispute the opposite facts. Taking note of the submissions, the writ petition is dismissed having become infructuous. due to the subsequent developments.
