ORAL ORDER

Learned HCGP is directed to take notice for respondent Nos.1 to 3.

2. During the course of arguments, it is submitted by the counsel for the petitioners, that respondent No.4 in Crl.P.No.11514/2024 lodged a private complaint before the learned Magistrate and also a complaint before the Avalahally Police against the petitioners alleging that the petitioners have forged the document pertaining to the property bearing Site

HC-KAR

No.204 (Old No.206), Katha No.260 situated at Kithaganur Village, Bidarahalli Hobli, Bangalore East Taluk. According to him, petitioner No.1 has purchased the same by sale deed dated 19.07.2016 and he has been in possession of the property and also constructed a residential house. Thereafter petitioner No.1 executed a sale deed in favour of petitioner No.2 and respondent No.2 is no way connected to the said property and his property in Site No.204 is a separate property. Despite, the Police have registered an FIR against the petitioners in both the cases. Accordingly, he prays to allow the petitions.

3. The learned HCGP has opposed the prayer and submits that investigation is in the nascent stage and except registering the FIR, the Police have not conducted the investigation in lieu of the interim order granted by this Court.

Placing rival submissions on record, the petitions stand disposed of by reserving liberty to the petitioners to approach the Investigating Officer by placing all the documents i.e., Sale Deed and other documents relied by them in these petitions as their defence and to explain the same before the Investigating

Officer within a period of two weeks from the date of receipt of copy of this order.

Upon such production of the documents by the petitioners, the Investigating Officer shall consider the same in accordance with law before filing the final report.

Till then, the Police officer shall not take coercive steps against the petitioners.
