ORAL JUDGMENT

1. The appellant has preferred this appeal against the order dated 09.09.2026 passed in Spl. SC IPC. SC & ST No.12/2024 by the II Addl. District and Sessions Judge, Kolar (for short, 'the trial Court').

2. For the sake of convenience, the parties herein are referred to as per their rank before the trial Court.

3. Brief facts leading to this appeal are that, on the basis of the complaint filed by Praveena R, Vemagal police

HC-KAR

have registered the case in Crime No.98/2024 against accused Nos.1 to 11 for the offence punishable under Sections 3(1)(r), 3(1)(s), 3(2)(v) of SC/ST (POA) Act, 1989 and Sections 506, 504, 143, 147, 148, 149, 302, 307, 323 and 324 of IPC, 1860. The appellant/accused was arrested by the police about 2 years ago. After investigation, the IO has submitted the charge sheet against accused Nos.1 to 16 for the offence punishable under Sections 143, 147, 148, 323, 324, 307, 302, 504, 506 read with Section 149 of IPC and Sections 3(1)(r), 3(1)(s) & 3(2)(v) of SC/ST (POA) Act, 1989.

4. Appellant/accused No.2 is in judicial custody. Two bail applications were filed on behalf of accused No.2 before the trial Court and same were rejected. Being aggrieved by rejection of bail applications, the appellant has preferred Criminal Appeal Nos.1946/2024 and 1603/2025. Both appeals came to be dismissed. After dismissal of these appeals, the trial Court has granted bail

HC-KAR

to accused No.1 though the appeals filed on behalf accused No.1 were dismissed. After disposal of those bail applications, the present appellant has filed bail application before the trial Court. Though the trial Court has granted bail to accused No.1, but rejected the same filed on behalf of accused No.2. It is submitted that other accused are on bail. The trial Court had already granted bail to accused No.2, on medical ground. Same is expired on 27.09.2026 and subsequently, same was extended till 30.09.2026.

5. As per accusation made on behalf of accused No.1 in charge sheet that, accused No.1 has assaulted the deceased-Ambarish with a club on his knee and when the deceased Ambarish tried to escape from him, accused No.1 and others have chased the deceased Ambarish. Accused No.1 gave blow to deceased Ambarish on the middle of the head causing bleeding injury to him. It is alleged by the prosecution accused No.2 fisted on the left

eye of deceased Ambarish. Except this, there is no other allegation. Since the prime accused are already on bail, it is just and proper to release the present appellant/accused also on bail, on the principle of parity. Accordingly, I proceed to pass the following:

O R D E R
