Heard on office objections. The same is over ruled.

2. It is submitted that as per the charge sheet, offences are mentioned.

3. Respondent No.2 present and submits that she has no objection to allow this appeal.

4. The appellant has preferred this appeal against the order dated 01.08.2025 passed by the Additional

District and Sessions Judge, FTSC-1 Shivamogga in Spl.C.No.162/2025.

5. On the basis of the complaint filed by Smt. Ambika, Paper Town Police registered a case against the accused in Cr.No.26/2025 for the offences punishable under Section 6 of Protection of Children from Sexual Offences Act, 2012, Sections 3(1)(w)(i)(ii), 3(2)(V) of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 and Sections 127(3), 137(2), 65(1), 64(2)(m), 127(4) of Bharatiya Nyaya Sanhita (BNS), 2023. During the course of investigation accused was arrested on 17.04.2025 and produced before the Court. He was remanded to judicial custody and till this day, he is in judicial custody.

6. After investigation, Investigating Officer has submitted the charge sheet against the accused for the offence under Section 6 of Protection of Children from Sexual Offences Act, 2012, Sections 3(1)(w)(i)(ii), 3(2)(V)

8. The learned counsel for the appellant would submit that while recording statement under Section

183(5) of BNS, 2023, the victim has not whispered anything about the alleged commission of the offences. The medical report does not reveal the detection of Seminal stains, Spermatozoa and Vaginal Epithelial cells. The FSL report is Negative. Further, it is submitted that the complainant has submitted a memo to release the accused on bail. Absolutely that there are no materials to constitute the alleged offences. Hence, sought for allowing of this appeal.

9. A perusal of statement under Section 183(5) of BNS, 2023, it is clear that the victim has not whispered anything against the accused as to the aggravated penetrative sexual assault.

10. On the contrary, the victim has voluntarily stated that she voluntarily went with the accused and he has not committed any offence. The accused is not required for further investigation, as the investigation is already completed. The mother of the victim has

submitted a written memo before the trial Court to release the accused on bail. The victim has also appeared before this Court and sought for release of the accused on bail.

11. Considering the nature and gravity of offences, the statement under Section 183 (5) of BNS, 2023 and the statement of mother of the victim submitted before the Court, without expressing any opinion on the merits of the case, it is just and proper to allow this appeal.

12. Accordingly, I proceed to pass the following:

ORDER

(i) Appeal is allowed.

(ii) The order dated 01.08.2025 passed by the Additional District and Sessions Judge, FTSC-1, Shivamogga in Spl.C.No.162/2025 is set aside. Consequently petition filed by the accused No.1 under Section 483 of BNS, 2023 is allowed.

a) The appellant/accused No.1 shall be released on bail on executing a self-bond of Rs.1,00,000/- (Rupees One Lakh Only) with one surety for likesum to the satisfaction of the trial Court.

b) The appellant/accused No.1 shall deposit the fine amount before the trial Court.

c) The appellant/accused No.1 shall appear before the trial Court on all the hearing dates without fail.

Registry is directed to communicate this order to the trial Court.
