ORAL ORDER

This petition is filed impugning the orders dated 19.08.2026 and 15.09.2026, wherein the Trial Court issued notice in respect of the applications filed in O.S.No.512/2026.

2. Learned counsel appearing for the petitioner submits that the petitioner instituted a suit for specific performance and during the pendency of the said suit, the defendants executed a sale deed in favour of a third party. The third party is attempting to effect changes in the revenue entries pursuant to the said alienation. It is submitted that, if further alienation is permitted, it would lead to multiplicity of proceedings and render the suit infructuous.

3. Considered the submissions made by learned counsel for the petitioner and perused the material on record.

4. In view of the limited nature of the direction being issued, notice to the respondents is dispensed with.

5. I.A.No.1 is filed under Order XXXIX Rules 1 and 2 read with Section 151 of CPC and I.A.No.3 is filed under Section 94(e) read with Section 151 of the CPC, wherein the Trial Court has issued emergent notice.

6. Considering the prima facie case made out, the respondents are restrained from effecting any change in the revenue entries in respect of the suit schedule property until adjudication of I.A. No.1 filed under Order XXXIX Rule 1 and 2 read with Section 151 of the CPC and I.A.No.3 filed under Section 94(e) read with Section 151 of CPC by the Trial Court. The said application shall be decided within one month from the date of receipt of a copy of this order.

With the above observations, the writ petition stands disposed of. Sd/- (K. V. ARAVIND) JUDGE
