ORAL ORDER

1. Learned counsel for the petitioner has filed a memo dated 28.09.2026 to withdraw the writ petition. The said memo reads as under:

"MEMO OF WITHDRAWAL

The Petitioner above-named most humbly submits as under:

1. The Petitioner has filed this Writ Petition seeking a writ of mandamus to direct the Respondent, i.e., the Competition Commission of India ("CCI") to consider the Petitioner's impleading application in Case No. 42 of 2023, wherein the Film and Television Producers Guild of India alleged contravention of the Competition Act, 2002 by UFO Moviez India Limited, Qube Cinema Technologies Private Limited and PVR Inox Limited ("PVR Inox") ("CCI Proceedings"). The CCI Proceedings concern the levy and collection of Virtual Print Fee ("VPF") the Petitioner.

2. The Petitioner raised several grounds in support of seeking a writ of mandamus including that if PVR Inox submits a commitment application committing to discontinue VPF, the same would create a binding precedent, without the Petitioner having any representation or participation in the CCI Proceedings. PVR Inox filed a commitment application on January 13, 2026.

3. The CCI has recently, on August 28, 2026 (received by the Petitioner on September 17, 2026) passed an order noting that certain entities, including the Petitioner herein have filed impleading applications in the CCI Digitally Signed by CHEPPUDIRA MONNAPPA POONACHA

HC-KAR

Proceedings and in view of the commitment application filed by PVR Inox, has forwarded a copy of the order to the impleading applicants (including the Petitioner), granting them liberty to file their comments, objections and suggestions. The CCI while granting the said opportunity to the Petitioner also noted the widespread impact of the commitment application.

4. In view of the above order of the CCI, the Petitioner does not wish to pursue this Writ Petition at this stage and respectfully seeks leave of this Hon'ble Court to withdraw this Writ Petition. It is further prayed that the withdrawal of this Writ Petition should not come in the way of the Petitioner to seek its rights and remedies in accordance with law. WHEREFORE, this Hon'ble Court may be pleased to dispose of the present Writ Petition on the above terms, in the interest of justice and equity.

PLACE:BENGALURU

Sd/- DATE:28.09.2026. ADVOCATE FOR THE PETITIONER"

In view of the memo, writ petition is dismissed as withdrawn.
