ORAL ORDER

The learned counsel for the revision petitioner files a Memo of even date which reads as under : "The undersigned counsel appearing for the petitioner the above matter most humbly request this Hon'ble court to permit him to convert the criminal revision petition filed by him by oversight to criminal appeal as the order of acquittal is being challenged. It is most humbly requested to take this memo on record and permit the petitioner herein above the above requested prayer in the interest of justice."

2. As per Section 419(4) of Bharatiya Nagarik Suraksha Sanhita, 2023 (in short 'BNSS'), the appeal against acquittal is maintainable and not the revision petition.

K B GEETHA

HC-KAR

3. Therefore, the memo is allowed. The revision petitioner is permitted to convert the criminal revision petition into criminal appeal, if he obtains special leave in the appeal.

For statistical purpose, the criminal revision petition stands disposed of.
