ORAL ORDER
The petitioners instituted the suit seeking a decree of permanent injunction and filed I.A. No.1/2026 under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure, 1908 (for short, ‘CPC’), seeking an ex parte ad interim temporary injunction restraining the defendants from interfering with the suit schedule property. The trial Court, by the impugned order, directed issuance of notice on I.A. No.1/2026 as well as on the suit.
HC-KAR
2. Learned counsel appearing for the petitioners submits that the suit schedule property is agricultural land with standing crops. It is further submitted that the defendants are attempting to interfere with the petitioners’ possession and, if such interference is not prevented, the standing crops are likely to be affected.
3. Considering the limited relief sought, this Court proposes to dispense with notice to the respondents.
4. By way of ad interim relief, both parties are directed to maintain status quo till consideration of I.A. No.1/2026 filed under Order XXXIX Rules 1 and 2 of the CPC. The trial Court is directed to expedite the hearing of the said application and dispose of the same within an outer limit of two months from the next date of hearing, i.e., 29.10.2026.
With the above observations, the writ petition stands disposed of.
