ORAL JUDGMENT

(PER: HON'BLE MR. JUSTICE D K SINGH)

This intra-court appeal has been filed impugning the order dated 30th April 2026 passed by the Writ Court in Writ Petition No.55167/2018 (L-RES) c/w W.P.No.2269/2022 (L-TER) filed by the appellant as well as the respondent respectively.

2. The respondent, who was the President of the Labour Union, was dismissed from service vide order dated 09.05.2013. Aggrieved by the said order of termination, the respondent-workman had raised an industrial dispute.

HC-KAR

The Labour Court vide award dated 08.11.2017 in Industrial Dispute No.115 of 2013 has set aside the order of termination dated 09.05.2013 and directed payment of 50% backwages with continuity of service and consequential benefits.

3. The learned Single Judge has laboured to consider the impugned award and submissions and has enhanced the backwages to 75% whereas retained and confirmed the order of reinstatement with continuity of service and consequential benefits.

4. We have considered the submissions of Mr.Kasturi, learned Senior Counsel appearing on behalf of the appellant and Mr.Anand B., learned counsel for the respondent/workman.

5. Respondent/workman has not pleaded that he was not employed anywhere during the interregnum period. In the absence of pleading and proof of unemployment, enhancing the backwages to 75% does

HC-KAR

not appear to be justified. Therefore, we allow this appeal partly and restore the award dated 08.11.2017 passed in Industrial Dispute No.115 of 2013. The respondent/workman would be entitled for 50% of backwages and continuity of service with consequential benefits.

If Section 17B wages have been paid, the same should be deducted from the backwages of 50%, which has been awarded to be paid to the respondent/workman. The backwages is directed to be paid within six weeks from today.
