ORAL JUDGMENT

(PER: HON'BLE MR. JUSTICE D K SINGH)

The present intra Court appeal has been filed impugning the order dated 10.07.2026 passed by the Writ Court in W.P.No.8573/2025 filed by the appellant whereby the writ petition filed by the appellant came to be dismissed.

2. The appellant/petitioner, in pursuance of the notification dated 26.04.2022 had applied for the posts of Junior Assistant as well as Dalayat in the Karnataka State

HC-KAR

Legislative Assembly Secretariat. The appellant/petitioner was selected for the post of Dalayat vide Office Memorandum dated 01.04.2023. He accordingly joined the post of Dalayat and has been continuing in service since then.

3. After a lapse of 19 months, the appellant/petitioner filed the writ petition claiming that he should have been appointed to the post of Junior Assistant instead of Dalayat. The writ court dismissed the writ petition on the ground of delay and laches noting that that the writ petition was filed after a delay of 19 months from the date of publication of final selection list.

4. Having heard the learned counsel for the appellant and having perused the material on record, we find no error in the order passed by the learned Single Judge warranting interference in the present intra-Court appeal. The appellant, having accepted the appointment to the post of Dalayat and having joined servic, after a considerable lapse of time cannot seek a direction for his appointment to a different post. Accordingly, the writ appeal stands dismissed.

HC-KAR

5. In view of dismissal of the appeal, pending IAs, if any, do not survive for consideration and accordingly, they stand disposed of.
