ORAL JUDGMENT

(PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN)

This writ petition is filed seeking a direction to respondent Nos.3, 4 and 5 to enforce the Stop-Work notice dated 04.08.2026 vide Annexure-A and take immediate steps for the removal and demolition of the unauthorized construction in Sy.No.97/2 of Kannamangala Village, Kasaba Hobli, Devanahalli Taluk. There is a further prayer seeking a direction respondent No.6-BESCOM to immediately disconnect the electricity supply provided to the unauthorized construction site in Sy.No.97/2 of Kannamangala Village, Devanahalli Taluk, vide Annexure-B.

2. The petitioner, who appears in person, submits that Annexure-A is the Stop-Work notice dated 04.08.2026, stating that the construction of the farmhouse exceeds 10% of the total land area of 1 acre

22 guntas in Sy.No.97/2 of Kannamangala Village, Kasaba Hobli, Devanahalli Taluk.

3. Learned Additional Government Advocate has placed a report on record before us today. It is submitted that the Karnataka Land Revenue Amendment Bill, 2015, which was notified on 12.08.2015, provides that the farm building or farm house shall not be more than 10% of the total extent of land, subject to the maximum extent of such land. It is further stated that the farm building or farmhouse means a house attached to a farm and constructed on a portion of agricultural land used for the residence of the agriculturalist or for the purpose of keeping agricultural implements.

4. It is stated that the Tahsildar had conducted a site visit on 20.08.2026 and that the sketch attached to the report visit would clearly show that the farm

buildings are erected on less than 10% of the 1 acre 22 guntas of the land in question. The copy of the sketch and the report prepared by the Taluk Surveyor are also placed on record.

5. Having considered the contentions advanced and in view of the reports submitted to the effect that the farmhouse in the property in question is constructed in less than 10% of the total land holding, we are of the opinion that the prayers raised in the writ petition cannot be allowed.

6. Accordingly, the writ petition is dismissed.
