ORAL ORDER

Learned counsel for the petitioners as well as learned counsel for respondent No.2 jointly submit that the parties have amicably settled their dispute. As such, the petitioners filed an application under Section 320 of Cr.P.C. to compound the offences against the petitioners and allow the petition.

2. The parties are present before the Court today. They both jointly submitted that the dispute between them has been settled as per the terms of Memorandum of Settlement dated 17.12.2025 in M.C.No.7306/2025, which produced along with memo dated 14.01.2026. As such, it is submitted by learned counsel for the petitioners that the proceedings challenged in this petition may be quashed against the petitioners.

3. Admittedly, the offences alleged against the petitioners are non-compoundable in nature, however, having regard to the fact that the dispute between the parties is purely private and matrimonial in nature, and in view of the principles laid down by the Hon'ble Apex Court in the case of GIAN

HC-KAR

SINGH vs. STATE OF PUNJAB AND ANOTHER, reported in (2012) 10 SCC 303, I am of the considered opinion that the settlement arrived at between the parties can be taken into consideration.

4. Accordingly, the application filed under Section 320 of Cr.P.C. is allowed. The petitioners and respondent No.2 are permitted to compound the offences.

5. Consequently, the petition is disposed of in terms of settlement. The proceedings against the petitioners/accused Nos.1 to 3 in C.C.No.27802/2023 (arising out of Crime No.246/2023 registered by Vidyaranyapura Police Station) for the offences punishable under Sections 498A, 323, 504, 506 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961, presently, pending on the file of 41st ACMM, Bengaluru is hereby quashed.
